Terms of Service

These Terms of Service ("Terms") govern your use of services provided by OrbitrionLabs, located at Rúa Nova, 8, 27001 Lugo, España. By engaging our services, you agree to be bound by these Terms.
1. Scope of Services
OrbitrionLabs provides AI & ML development services including, but not limited to: custom ML model training, predictive analytics, NLP solutions, computer vision systems, MLOps deployment, generative AI integration, data engineering, AI-powered automation, and edge AI inference. The specific scope, deliverables, timeline, and pricing for each engagement are defined in individual project agreements or order forms.
2. Payment Terms
All prices are quoted in Euros (€) unless otherwise stated. Payment terms:
- A 50% deposit is required before work commences on any project.
- The remaining 50% is due upon delivery and acceptance of the final deliverables.
- Payment is processed via Stripe through our secure payment link.
- Invoices not paid within 14 days of the due date may incur a 2% monthly late fee.
3. Project Milestones & Deliverables
Each project is delivered according to the milestones defined in the project agreement. Client feedback is expected within 5 business days of each milestone delivery. Delays in feedback may result in adjusted timelines. All deliverables are provided as specified in the project scope; additional features or scope changes are subject to separate quotation.
4. Intellectual Property
Upon full payment, the client receives full ownership of all custom-developed deliverables specifically created for the project as outlined in the project agreement. OrbitrionLabs retains ownership of pre-existing tools, frameworks, libraries, and general methodologies used in service delivery. Third-party components remain subject to their original licenses.
5. Confidentiality
Both parties agree to maintain strict confidentiality regarding proprietary information, trade secrets, business data, and project details. This obligation survives termination of the service agreement for a period of 24 months.
6. Limitation of Liability
OrbitrionLabs shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
7. Termination
Either party may terminate a project agreement with 14 days written notice. In case of termination, the client is responsible for payment of all work completed up to the termination date. Deposits are non-refundable once work has commenced.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes shall be resolved in the courts of Lugo, España.
Refund Policy

At OrbitrionLabs, located at Rúa Nova, 8, 27001 Lugo, España, we are committed to delivering high-quality AI & ML services. This Refund Policy outlines the conditions under which refunds may be issued.
1. Deposit Refunds
The initial 50% deposit is fully refundable if cancelled before work has commenced. Once work has begun on any project milestone, the deposit becomes non-refundable as it covers initial resource allocation, project setup, and computational costs.
2. Completed Work
Payment for completed milestones and delivered work is non-refundable. Each milestone delivery constitutes a completed unit of work. If deliverables do not meet the specifications outlined in the project agreement, we will, at our discretion, either revise the deliverables at no additional cost or issue a partial refund for the affected milestone.
3. Disputed Deliverables
If you believe delivered work does not meet the agreed-upon specifications, you must notify us in writing within 10 business days of delivery. We will review the dispute and work toward a resolution, which may include revision, partial refund, or mediation as appropriate.
4. Subscription & Retainer Services
For ongoing retainer or subscription-based services, you may cancel with 30 days written notice. Refunds for the current billing period are not available once services have been rendered. Future billing will cease upon cancellation.
5. How to Request a Refund
To request a refund, contact us at [email protected] with your project details, invoice number, and reason for the refund request. We will respond within 5 business days. Approved refunds are processed via the original payment method within 14 business days.
6. Exceptions
Refund requests may be denied if: (a) the project scope was modified by the client during execution, (b) delays were caused by the client's failure to provide required data or feedback, or (c) the refund request falls outside the time limits specified above.
